Tobacco Stores Premium Lounge Upsell - Terms and Conditions
1) INTRODUCTION
These terms and conditions (“Upsell Terms”) govern the purchase and use of any upgrade, package, or upsell product (“Upsell”) offered in connection with an event (“Event”) held in a venue (“Venue”) operated by Academy Music Group Limited (“we”, “us”, “our”).
These terms incorporate, and should be read in accordance with:
the terms and conditions of the Event organiser (if not us) (“Organiser”) and the authorised ticket agent from whom you purchased your ticket (“Agent”), copies of which are available upon request from the Organiser and/or the Agent.
All of the above terms are collectively referred to as the “Terms and Conditions”.
2) VALIDITY AND REQUIREMENT OF ENTRY
An Upsell does not constitute a ticket to an Event.
An Upsell is only valid when used in addition to a valid event ticket for the relevant Event.
Where an Upsell is purchased without a valid ticket:
no access will be granted; and
no refund or compensation will be provided.
3) PURCHASE CONDITIONS
Unless otherwise stated:
Upsells are limited to one (1) per person;
Only one Upsell may be used per valid event ticket; and
All purchases are subject to availability.
Upsells may only be exchanged, refunded or cancelled where the tickets to which they relate are exchanged, refunded or cancelled, or as otherwise permitted under our Ticketing Terms and Conditions.
As stated in the Ticketing Terms and Conditions, tickets cannot be exchanged or refunded except where the relevant Event is cancelled, rescheduled, or subject to a material change, as determined by the Agent or Organiser in accordance with the Ticketing Terms and Conditions.
4) SCOPE OF THE UPSELLS
The Upsell entitles the holder only to the specific benefits described at the time of purchase.
The Upsell does not guarantee:
access to specific areas beyond those stated; or
availability of all advertised features at all times.
All Upsell benefits are subject to:
availability; and
Venue policies.
5) VOUCHERS AND DRINK TOKENS
Where the Upsell includes vouchers (including drink tokens), such vouchers:
are valid only for the Event for which they were purchased;
are not reusable at any other event or in future years; and
cannot be exchanged for cash or any other alternative.
Where a drink token is provided as part of an Upsell:
it may be redeemed for a drink at the Venue, subject to availability; and
alcoholic beverages will only be supplied to persons aged 18 or over, subject to valid age verification. Challenge 25 policies will apply.
If you are unable to provide valid proof of age on request:
alcoholic products will not be served to you; and
a non-alcoholic alternative may be offered at our discretion.
6) AGE RESTRICTION
Upsells are subject to any age restrictions applicable to the Event or specific areas of the Venue, as set out in the relevant Venue’s Terms and Conditions of Entry.
Certain Upsell areas or benefits may be restricted (in whole or at certain times) to persons aged 18 or over and/or in accordance with applicable licensing conditions.
Where licensing conditions apply:
access to certain Upsell benefits or areas of the Venue may be refused or withdrawn; and
you may be required to leave such areas at the relevant time.
Where you are unable to access any part of an Upsell due to:
age restrictions;
failure to provide valid identification; or
licensing or operational requirements (including time-based restrictions),
no refund or compensation will be provided.
7) DISPUTES AND GOVERNING LAW
Any dispute arising out of or in connection with these Upsell Terms shall be dealt with in accordance with the dispute resolution provisions set out in our Ticketing Terms and Conditions, including the STAR Code of Practice and Dispute Resolution Procedure.
These Upsell Terms shall be governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the English courts.
