TERMS AND CONDITIONS - FIREBALL SUPPORT ACT COMPETITION

 
1 INTRODUCTION
 
This Competition (as defined below) is operated by Academy Music Group Limited, company number 03463738, whose registered office is 211 Stockwell Road, London, SW9 9SL (“Our”, "Us" and "We")
 
1.1 Please read these Terms and Conditions carefully.  These Terms and Conditions set out who can enter the Competition, how the Competition will be run and the circumstances in which we may withhold all or part of the Prize (as defined below) and/or disqualify you. By submitting an entry for the Competition, you agree to be bound by these Terms and Conditions and agree that if you win, you will grant to us the right to use your name and/or image in our publicity as set out below.
 
1.2 The prize is for a local band to support Less Than Jake on the Fireball ‘Fuelling the Fire Tour’ 2019. There will be one local band chosen for each date of the tour which is being hosted at the below venues on the below dates. There will be 8 separate bands who win one support slot each. On entering, the band must select which O2 Academy date is their local venue. Each venue will have its own pool of competitor bands out of which there may only be one winner per venue. If they win, they will play the opening support slot at their chosen local venue and not support on any other dates across the tour.  Winners (all members of the band) must be over 18. All members of the band will be asked to prove their age by sending a scanned copy of a valid passport for each band member to Academy Music Group. All other costs and expenses, including food and drink, travel insurance and other additional costs that arise are the responsibility of the bands selected. The winners at each venue will be provided with basic backline, all bands must provide their own amp and own instruments. Prize must be taken on the date of the relevant venue as per below:

O2 Ritz Manchester – 23.09.2019
O2 Academy Newcastle – 24.09.2019

O2 Academy Brixton -28.09.2019
 
1.3 Academy Events and Fireball Brand Ambassador will choose a ‘Fireball Hottest Band’ from the local support bands from each tour date. This band will be chosen based on their performance on the tour and quality of music. This band will receive additional support from Academy Events and Fireball UK.
 
1.4 We reserve the right to cancel or amend these Terms and Conditions at any time without prior notice if circumstances render such cancellation or termination unavoidable.  When you enter the Competition you are deemed to accept the Terms and Conditions at the date you enter.
 
1.5 Any amendments or cancellations to these Terms and Conditions will be posted on the Academy Music Group venue website, here: Open for the Fireball: Fuelling The Fire Tour 2019
 
1.6 We reserve the right to disqualify you if we have reasonable grounds to believe that you have breached any of these Terms and Conditions.
 
1.7 We reserve the right to disqualify you and/or report, remove or block you from the competition and the Fireball, Fuelling The Fire tour dates if your entry or any comment from you is, or may reasonably be considered to be, defamatory, libellous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, corporation or entity.
 
2 ELIGIBILITY
 
2.1 To enter the Competition the band and each band member must:
(a)    be resident in the United Kingdom;
(b)    be able to comply with all the Terms and Conditions; and
(c)    be at least 18 years old.
 Further, at least 2 band members must live within 30 miles of the ‘local’ venue they apply to play.
 
2.2 You must not be an employee, agent or a director of, or a member of the family of an employee, agent or director of:
 
(a) Us or any of Our associated companies or subsidiaries; or 
(b) any advertising agency or web company connected with Us.
 
2.3 You can only enter this competition once. No third party entries, bulk entries or entries submitted by agents will be accepted.
 
2.4 We reserve the right to verify the eligibility of entrants. We may request such information as we consider reasonably necessary for the purpose of verifying the eligibility of an entrant and Prizes may be withheld until and unless We are satisfied with the verification.
 
3 ENTRY REQUIREMENTS
 
3.1 The Competition will open at 12pm on June 30th 2019. Entries to the competition must be received by Us by 11.59pm on August 1st 2019 (“Closing Time”).
 
3.2 To enter the Competition, entrants need to enter the details and supply access to a musical performance recording of the band as required by the dedicated competition form hosted on the Competition web page on the Academy Music Group website before the Closing Time. Try to ensure your entry demonstrates your band’s musical talent and experience as this is what entries will be judged on.
 
3.3 We cannot be held responsible for entries which are lost or corrupted nor for any entries to the Competition which We do not receive as a result of any technical error, however caused.  In addition We cannot accept any liability for any difficulties experienced in submitting an entry.  Proof of entry or submission will not be deemed to be proof of receipt.
 
4 SELECTION OF THE WINNER
 
4.1 Between 31st July and 7th  August, a board of judges comprising of  Academy Event promoters, venue staff and our Fireball brand team will select winners from all entries for that Competition received by Us which comply with these Terms and Conditions. The judges will make their decision based on the bands’ musical talent, experience, and how well that band will complement the other acts playing at the relevant venue.
 
4.2 The winning band (and individually, each band member) selected pursuant to clause 4.1 shall be a “Winner”.
 
4.3 The Winners will be notified by Us by email or telephone on 9th  August – and winners must confirm they can play the relevant dates by 6pm 9th August. If We notify you that you have been selected as a Winner and you do not acknowledge such notification by 6pm on 9th  August, We shall be entitled to withdraw your selection as a Winner and may select an alternative winner in Our absolute discretion.
 
4.4 The Winners will be publically announced through O2 Academy and Fireball UK social media channels on 12th  August, We ask that the Winners do not announce on their own marketing channels, including social media, before the agreed time on this date.
 
4.5 Entrants are responsible for ensuring they will be able to accept the Prize in accordance with these Terms and Conditions.  In the event a Winner is unable to do so then We reserve the right to reward the Prize to another eligible entrant using the criteria set out in clause 4.1 (and so on until a winner who is eligible and able to accept the Prize is found).
 
4.6 There are no Prize substitutions or cash alternatives and the Prize is not transferable.
 
4.7 Where for reasons outside of Our reasonable control We are unable to deliver to the Winner the whole or any part of the Prize We shall have the right to substitute all or part of the Prize offered for an alternative prize which We reasonably nominate.
 
4.8 The Winners will be solely responsible for all their own expenses, we assume no responsibility and are not liable for any costs, charges, expenses or taxes which the Winners may be required to pay at any time in connection with the Prize. The Winners and any permitted companion shall at all times be subject to all applicable ticket terms and conditions and festival rules.
 
5 WINNERS
 
You agree that if you are a Winner:
 
5.1 You will not resell, offer for hire or otherwise transfer the Prize to any third party; and
 
5.2 In all matters Our decision will be final and no correspondence or discussion shall be entered into with you or any other party on your behalf regarding the process or details of such decision.
 
5.3 If We have grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating any voting, choice of Winner(s) or any entry or establishing multiple accounts in order to gain multiple entries (or cast multiple votes) where the number of entries is limited) We reserve the right (in our sole discretion) to disqualify any entrant, entry or person We reasonably believe to be responsible for, or associated with, such activity.
 
6 LIMITATION OF LIABILITY
 
6.1 We cannot be held responsible for any costs incurred by you in entering the Competition (whether or not such entry is successful) or in relation to you taking part in the Competition.  
 
6.2 We will not be responsible for any losses you suffer as a result of Our breach of these Terms and Conditions unless those losses were reasonably foreseeable to both you and Us at the date you enter the Competition.  
 
6.3 Subject to clause 6.4, for the avoidance of doubt, We will not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with the Competition for: 
 
(a) loss of revenues, profits, contracts, business or anticipated savings or loss of data; or 
(b) any loss of goodwill or reputation; or 
(c) any special or indirect or consequential losses
however caused.
 
6.4 Nothing in these Terms and Conditions shall exclude or limit Our liability: 
 
(a) for death or personal injury resulting from Our negligence or a deliberate act or omission of Us or any of Our officers, employees or agents; 
(b) for fraudulent misrepresentation; or 
(c) to the extent that such liability cannot by law be excluded or limited. 
 
6.5 We will not be liable for any damages or losses as a result of failure by Us to deliver the Competition, the Prize or any other prizes as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data non-delivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and / or failure or lack of reception of telephone or mobile telephone networks. 
 
7 YOUR DATA
 
Your personal data will be used solely in accordance with the current data protection legislation and in accordance with Our Privacy Policy which governs Our use of personal data We collect from you. We will use each Winner’s, and each entrant’s personal details for the purpose of administering this Competition.  Please note that entrants’ data may be transferred to, processed and/or stored outside the European Economic Area; by entering this Competition you are indicating your consent to this.
 
8 GOVERNING LAW
 
8.1 These Terms and Conditions are governed by and construed in accordance with English Law and any dispute arising from them shall be subject to the non-exclusive jurisdiction of the English Courts.

9.2 The Winner’s names will be made available on receipt of a stamped self-addressed envelope by Us.
 
9.3 All enquiries regarding the Competition (including requests for details of the Winner) must be received by Us within 7 days of each closing date of the Competition as set out in condition 3.1.
